Online Brand Building Academy ("the Academy," "we," "us," or "our") is an online membership platform operated by FK Holdings LLC, and Tempest Holdings LLC, doing business as Online Brand Building Academy. This Privacy Policy explains what information we collect when you use the Academy or our related websites, landing pages, and event registration pages (including webinar registration), how we use it, and the choices you have.

By creating an account, registering for an event, or using the Academy, you agree to the collection and use of information as described in this policy.

1. INFORMATION WE COLLECT

Information you provide directly: • When you create an account, we collect your name, email address, phone number, and password. If you add a profile picture or edit your profile, we store that as well. If you contact us, participate in the community, send direct messages, or message our team through the platform inbox, we store the content of those communications.

• When you schedule a call with us for one of our paid programs and check the consent box, we collect your name, email address, and phone number, along with a record of your consent to a credit screening as described in the "Credit Screening and FCRA" section below.

• When you register for a webinar, live training, or other event through one of our registration pages, we collect your name, email address, and phone number, along with a record of your consent to receive communications.

Information collected automatically: • As you use the Academy, we collect activity data such as pages visited, courses and lessons viewed, resources accessed, links clicked, and general usage patterns. We use this to understand how members use the platform, improve our content, and keep the Academy running smoothly.

Membership and verification information: • We store information about your membership tier, plan verification status, and onboarding progress so we can show you the right content and features.

AI feature interactions: • The Academy includes AI-powered features, such as AI assistants and chat experiences. When you interact with these features, we collect and store the content of those interactions, including the questions you ask and the conversations you have.

Communications: • SMS/Text messaging: If you opt in to receive text messages from us — for example, when registering for a webinar or training — we collect your phone number and a record of your consent, and use it to send registration confirmations, event reminders, and related updates, as well as recurring automated marketing and promotional messages about our free trainings, new content, and offers. Message frequency varies. Message and data rates may apply. You can opt out at any time by replying STOP, or reply HELP for help. No mobile opt-in data or consent information will be shared with or sold to third parties or affiliates for their marketing or promotional purposes; sharing with service providers acting on our behalf (such as our messaging delivery provider) is permitted solely to deliver the messages you signed up for.

Credit Screening (Fair Credit Reporting Act/FCRA): When you book a call for one of our paid programs through our scheduling pages, you may be asked to authorize a credit screening. This screening is optional and only occurs if you affirmatively check the consent box on the scheduling form. If you do not consent, no screening is performed and you can still book the call.

If you consent, your name, phone number, and other identifying information you provide are securely transmitted to our scheduling and screening service provider, which obtains a consumer report from a nationwide consumer reporting agency. The screening is a "soft inquiry," which means it does not affect your credit score and is not visible to other lenders.

The screening may return information such as a credit score range, estimated debt-to-income ratio, estimated income, and a pre-qualification indicator. We use this information solely to determine whether our paid programs and any associated financing options are a good fit for you, and primarily to route your inquiry to the appropriate member of our team. We do not use it for any other purpose, and we do not use it to make decisions about your access to the Academy's free content or your existing membership.

We obtain and use this information in compliance with the Fair Credit Reporting Act (15 U.S.C. § 1681 et seq.), based on your written authorization. The information is retained only as long as necessary for the purpose described above and is then deleted, subject to any record-keeping obligations. We do not sell this information or share it with third parties for their own marketing purposes.

You have rights under the FCRA, including the right to know what is in your consumer file, to dispute inaccurate information with the consumer reporting agency, and to obtain a free copy of your report from each nationwide agency once every 12 months at annualcreditreport.com. A summary of your rights under the FCRA is available from the Consumer Financial Protection Bureau at consumerfinance.gov. If we take any action regarding your inquiry based in whole or in part on information in a consumer report, we will provide you with notice as required by law.

2. HOW WE USE YOUR INFORMATION

We use the information we collect to: • Provide, operate, and maintain the Academy, including your account, course access, community features, and messaging. • Personalize your experience, such as showing content appropriate to your membership tier and tracking your progress. • Communicate with you about your account, platform updates, new content, and offers we believe are relevant to you. • Understand how the platform is used so we can improve content, features, and performance. • Maintain the safety and integrity of the platform, including enforcing our Terms of Use and preventing abuse.

3. AI FEATURES AND HOW YOUR INTERACTIONS ARE USED

The Academy offers AI-powered features, including AI assistants trained on our own content and expertise.

When you use these features, your conversations are recorded and stored. Our team may review these conversations to monitor quality, understand what members are asking, and improve our content and support.

We also use member interactions with our AI features to improve and refine those features over time. This means the questions you ask and the conversations you have may be used to make our AI assistants more accurate and more useful. We use these interactions to improve our own AI features — we do not sell your conversations to third parties.

Our AI features are powered in part by third-party AI service providers, and your interactions with these features are processed by those providers on our behalf in order to deliver the experience.

Do not share sensitive personal information (such as financial account numbers, government ID numbers, or health information) in conversations with AI features.

4. COMMUNITY CONTENT AND VISIBILITY

The Academy includes community features. Content you post in community spaces — including posts, comments, and your profile name and picture — is visible to other members. Think of community spaces as semi-public within the membership: anything you share there can be seen by the people in it.

Direct messages are visible to the participants in the conversation and to our team where necessary for support, safety, and enforcement of our Terms of Use.

5. CALLS AND RECORDINGS

The Academy hosts live calls and sessions for members. These calls may be recorded, and recordings may be made available to members as content on the platform. By participating in a call — including appearing on camera, speaking, or asking questions — you consent to being included in the recording. If you prefer not to appear, you can keep your camera and microphone off and participate through chat, subject to how each session is run.

6. THIRD-PARTY SERVICES AND LINKS

The Academy recommends third-party software, tools, and services, and contains links that take you to third-party websites. Some of these are affiliate or partner links, which means we may receive compensation if you sign up for or purchase those services. When you click a link and leave the Academy, this Privacy Policy no longer applies — the third party's own privacy policy governs any information you provide to them. We encourage you to review the privacy policies of any third-party service before signing up.

We use third-party service providers to host and operate the platform, deliver emails and text messages, power our AI features, and analyze platform usage. These providers process information on our behalf and are not permitted to use it for their own purposes beyond providing services to us.

We do not sell your personal information.

7. AGGREGATED AND ANONYMIZED DATA

We may aggregate or anonymize information so that it no longer identifies you — for example, statistics about how many members completed a course or which resources are most popular. We may use and share aggregated or anonymized data for any purpose, including analytics and marketing, since it does not identify any individual member.

8. COOKIES AND SIMILAR TECHNOLOGIES

The Academy uses cookies and similar technologies to keep you logged in, remember your preferences, and understand platform usage. Most browsers let you control or delete cookies through their settings. Disabling cookies may limit your ability to use some features of the platform, including staying logged in.

9. DATA RETENTION

We retain your information for as long as your account is active or as needed to provide you the Academy's services. If your account is closed, we may retain certain information as required for legitimate business purposes, such as record-keeping, dispute resolution, and enforcing our agreements. Community content and call recordings may persist as part of the platform after your account closes, though your account information will no longer be associated with an active membership.

10. YOUR CHOICES AND RIGHTS

You can access and update your profile information at any time through your account settings.

You can opt out of marketing emails and text messages by following the unsubscribe instructions in those messages or contacting us directly.

You can request a copy of the personal information we hold about you, or request that we delete it, by contacting us at the email below. We will respond to verified requests within a reasonable timeframe. Depending on where you live, you may have additional rights under applicable privacy laws, and we will honor those rights as required.

11. CHILDREN'S PRIVACY

The Academy is not directed at anyone under the age of 18, and we do not knowingly collect personal information from anyone under 18. If we learn that we have collected information from someone under 18, we will delete it. If you believe a minor has provided us information, please contact us at the email below.

12. DATA SECURITY

We take reasonable technical and organizational measures to protect your information from unauthorized access, loss, or misuse. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.

13. CHANGES TO THIS POLICY

We may update this Privacy Policy from time to time. When we do, we will revise the "Last updated" date at the top of this page. Material changes may also be communicated through the platform. Your continued use of the Academy after changes take effect constitutes acceptance of the updated policy.
